I offer acrylic watercolour graphite pencil and oils and I can do any standard size or custom sizes.
1. Acceptance
It is not necessary for the Client to have signed any document for these Terms and Conditions to apply. By commissioning artwork or purchasing from Sebastian Dean Art, the Client is deemed to have read, understood, and accepted these Terms and Conditions in full.
Please read these Terms and Conditions carefully. Commissioning artwork or using services implies full acceptance of these terms.
2. Description of Product
Commissioned artwork will be based on either:
- A photograph provided by the Client (e.g. a photo of a pet), or
- A mutually agreed-upon description for abstract work.
The Client and the Artist will work together to select a suitable photo reference. However, the Artist reserves the right to decline a commission if a high-quality reference photo cannot be provided.
3. Photograph Rights
If the reference photo is not owned by the Client:
- The Client must obtain permission from the original photographer or copyright holder.
- This includes any images taken by professional photographers.
4. Payment
- Prices are subject to change.
- Once a 50% non-refundable deposit is received, the price is fixed.
- Payment can be made via the website, bank transfer, or other agreed-upon methods.
- The 50% deposit secures the Client’s booking or reservation of original artwork.
Final Payment:
- The remaining 50% is due within 30 days of artwork completion.
- Artwork will not be shipped until the full payment is received.
- If final payment is not received within 30 days, the artwork will be offered for public sale, and the deposit will not be refunded.
If the Client is not satisfied with the commissioned piece:
- And the issue cannot be resolved with minor alterations, the final payment will not be required.
- However, the Client will not receive the artwork.
- If the artwork is deemed suitable for public sale (e.g. not based on personal imagery), it may be sold.
5. Target Dates
- A target completion date will be agreed upon before work begins.
- Once the product is dispatched, delivery timelines are outside the Artist’s control.
6. Delivery of Product
- Artwork will be shipped from the UK using tracked delivery or can be collected in person.
- The Client will receive a tracking number upon dispatch.
- Overseas shipping fees will be added to the final balance.
- Artwork will be packaged securely.
7. Returns
Returns are not accepted due to change of mind.
Returns are only accepted if:
- The artwork is damaged prior to receipt and
- The damage is reported within 48 hours of delivery.
The Client is responsible for:
- Contacting the Artist within the timeframe
- Returning the item
- Covering the return shipping costs
8. Copyright
- The Artist retains full copyright over all works created.
- The Artist may use images of the artwork for portfolios, website content, and social media promotion.
Portraits of people will not be published without the Client’s explicit permission for privacy reasons.
The Client may not:
- Reproduce or sell copies of the artwork in any format without written permission from the Artist.
9. Data Protection
The Artist will collect only the following information:
- Client’s name
- Email address
- Delivery address
This data is used solely for:
- Invoicing
- Order fulfillment
Once the order is completed and delivered:
- Contact information will be deleted
- Any printed or digital reference photos will be deleted or destroyed
10. Artwork Progress
- Progress photos will be shared with the Client once work begins.
- Minor changes may be requested at this stage.
The Artist (Sebastian Dean) reserves the right to share “work-in-progress” images on social media unless:
- The Client requests otherwise (e.g. the piece is a surprise gift)
If the artwork is a gift:
- No images will be published until after the gift has been given.
